Return of Foreigners

  • Requirements
    • Foreigners who have been expelled contravene the entry ban in Spain.
    • For these purposes, the prohibition of entry into Spain will be considered counter-evidence, regardless of whether it was adopted by the Spanish authorities or by those of any of the States with which Spain has signed an agreement in that regard.
    • Foreigners who seek to enter the country irregularly. Foreigners who are intercepted at or near the border will be considered included for this purpose.
    • An expulsion order will not be necessary for the return of foreigners found in any of the above cases.
  • Classes and typologies
    • The two cases mentioned in the previous section.
  • Period of validity
    • The execution of the return will entail the new beginning of the calculation of the term of prohibition of entry against avenue, when it had been adopted by virtue of an expulsion resolution issued by the Spanish authorities. Likewise, any return agreed in application of paragraph (b) indicated in the first paragraph shall entail the prohibition of entry into Spanish territory for a maximum period of three years.
