Foreigner Procedures

Requirements
- Foreigners who have been expelled contravene the ban on entry into Spain.
- For these purposes, the ban on entry into Spain will be considered as a counter-measure when this is stated, regardless of whether it was adopted by the Spanish authorities or by those of any of the States with which Spain has signed an agreement to that effect.
- Foreigners who intend to enter the country irregularly. Foreigners who are intercepted at or near the border will be deemed to be included for this purpose.
- An expulsion order will not be required for the return of foreigners found in any of the above cases.

Period of validity
- The execution of the refund will entail the new beginning of the calculation of the period of prohibition of entry against the street, when it had been adopted pursuant to an expulsion decision issued by the Spanish authorities. Likewise, any refund agreed pursuant to paragraph (b) referred to in the first paragraph shall entail a ban on entry into Spanish territory for a maximum period of three years.

    - Time-limit for lodging the appeal: 1 month express act, 3 months presumptive act.
  - Contentious - Administrative
    - Organ that resolves the appeal:
      - Judgments of the Contentious.
    - Time-limit for lodging the appeal: 2 months.
