Foreigner Procedures

Annual extension of the authorization of stay for studies, student mobility, non-work practices or voluntary services.

The extension must be requested during the sixty calendar days prior to the expiration date of the validity of your authorization.
Who are the stakeholders?

Foreigner holding a residence permit who has been authorized to stay in Spain for the sole or principal purpose of carrying out any of the following non-employment activities:
- Realization or expansion of studies in an authorized educational center in Spain, in a full-time program, leading to the obtaining of a degree or certificate of studies.
- Carrying out research or training activities, without prejudice to the special regime of researchers.
- Participation in a student mobility program, to follow a high school and/or baccalaureate program in an officially recognized teaching or scientific center.
- Carrying out non-work practices in a public or private body or entity.
- Provision of a volunteer service within a program that pursues objectives of general interest.
Period of validity
- The authorization of stay may be extended annually when the interested party proves that he continues to meet the requirements set forth in art. 38 of the Regulations of Organic Law 4/2000, both of a general nature and specific with respect to the activity for which he was authorized to stay in Spain.

- Subject of the procedure: CIVIL RIGHTS, FREEDOMS AND RELATIONS.
- Resolution of the procedure:
  - Bodies competent to resolve this procedure:
    - By delegation:
      - Government Delegates/Subdelegates.
  - The resolution of the procedure does put an end to the administrative route.
  - Maximum period for resolving and notifying: 3 months from the day following the date on which they entered the register of the body competent to process them.
  - Effect of the lack of resolution in this period: Dismissal (initiation at the request of the interested party).
- Resources that can be interposed:
  - Replacement
    - Organ that resolves the resource: Organ that dictated the act.
    - Period for lodging an appeal: 1 month.
  - Contentious - Administrative
    - Organ that resolves the resource:
      - Contentious Court - Administrative.
      - Central Administrative Litigation Courts; Administrative Litigation Chambers of the High Court of Justice.
      - Administrative Litigation Division of the National High Court; Administrative Litigation Division of the Supreme Court.
    - Period for lodging an appeal: 2 months.

Where can I process my application?
- The application may be submitted in the places provided for in art. 38.4 of Law 30/1992, of 26 November, on the Legal Regime of Public Administrations and Common Administrative Procedure, or in accordance with the provisions of Law 11/2007, of 22 June, on electronic access for citizens to public services.
