Foreigner Procedures

Prove the status of non-resident foreigner in Spain.

It is requested by the interested foreigner to prove your status as a non-resident in Spain.

Who are the interested parties?
- All foreigners, EU and non-EU nationals.
Period of validity
- 3 months since your expedition.
Resolution of the procedure
- The procedure must be completed within a maximum period of five days from the entry of the application in the register of the body responsible for processing it. The decision must be notified within that period, after which without having received a reply, it will be understood that the request has been rejected.

  - The procedure must be resolved within a maximum period of five days from the entry of the application in the register of the competent body for processing.
  - The decision on the procedure does put an end to the administrative procedure.
  - Effect of the lack of resolution in this period: Dismissal (initiation at the request of the interested party).

  - Replenishment
    - Organ that resolves the appeal: Organ that dictated the act.
    - Time-limit for lodging the appeal: 1 month.
  - Contentious - Administrative
    - Organ that resolves the appeal:
      - Contentious Court - Administrative.
      - Central Administrative Litigation Courts; Administrative Litigation Chambers of the High Court of Justice.
      - Administrative Litigation Chamber of the National Court; Administrative Litigation Chamber of the Supreme Court.
    - Time-limit for lodging the appeal: 2 months.

Where do I swap my application?
- The Directorate-General of Police is requested either directly or through the Immigration Offices. Opens a new window. External link. or Police Stations. In the event that the foreigner is not in Spanish territory at the time of the application, the General Commissariat of Foreigners and Borders will be requested, through the Spanish Consular Offices abroad.
