Right to Deletion of data from the file "PERPOL"

Article 18.4 of the Spanish Constitution recognizes the fundamental right to the protection of personal data. The purpose of this procedure is to publicize the mechanism, within the scope of the Ministry of the Interior, for the exercise of the rights that the current legislation grants to citizens.

The rights listed below are of a very personal and independent nature, so that the exercise of one is not a requirement for the exercise of the other, being regulated in Organic Law 7/2021, of May 26, on the protection of personal data processed for the purposes of prevention, detection, investigation and prosecution of criminal offences and execution of criminal sanctions.

The exercise by the affected party of their rights will be free of charge.

  • Formal requirements to exercise the right of deletion of data from the file "PERPOL"
    • Being a very personal right, it will be exercised by a request addressed to the person in charge of the file for the management of the background of persons of police interest (PERPOL) by a means that guarantees their identification and that accredits the shipment.
    • The request for deletion must indicate to which data it refers.
  • Face-to-face
    • The application together with the documentation that must accompany it must be submitted at the level of the National Police in any Police Station, National Police Registers or in the Central Police Archive or in any of the registers referred to in Law 39/2015, of 1 October, on the Common Administrative Procedure of Public Administrations.     • Acting through representative
      • The rights may be exercised through:
        • Legal representative, when the affected person is in a situation of incapacity or minority of age that prevents the personal exercise of these rights, in which case the accreditation of such condition will be necessary.
        • Voluntary representative, expressly designated for the exercise of the right. In this case, the identity of the representative and the representation conferred by him must be clearly established.
    • Resolution of the request for deletion
        • The request for deletion of data from the file for the background management of persons of police interest (PERPOL) will be resolved within a maximum period of one month from the receipt of the request.
    • Communication with the applicant:
        • It will be done through the Police Unit closest to the home indicated in the request for notification.
  • Online
    • Instructions for the suppression form to the police records of the General Directorate of Police:
    • Data of the interested party.
      • Fill in all the mandatory data to perfectly identify the interested party.
      • It is advisable to fill in both the telephone and the email, as it facilitates the administration to contact the interested party in case of doubt about any aspect of the file, as well as receive a notice about the availability of access to the notification, in case of choosing electronic means such as the preferred one in the procedure.
    • Request.
      • It is necessary to explain which data is the one that is intended to be canceled, if all or only one for which the respective documentation is presented.
      • In order to remove any police record, it is mandatory to present the judicial or administrative certificate, which justifies the cancellation of the same in a judicial or administrative way, in a firm or definitive way, and perfectly related to the police record or date and place of the detention that is intended to be removed.
      • It is also mandatory to attach everything necessary to correctly identify the interested party.
      • In case of acting as a representative, the representative relationship must be accredited, as well as the filiation of the interested party by means of a copy of his personal document (DNI/NIE/Passport).
    • Notifications.
      • Choose the means of notification for the file, or by electronic appearance with electronic certificate.
      • Or paper notification, for which all the data of the full address will have to be duly filled in.
    • Protection of data.

  • Model of application.
  • The exercise of the rights must be carried out by means of a communication addressed to the person in charge of the file for the management of the background of persons of police interest (PERPOL), which will contain:
    • Name and surname of the interested party.
    • Request in which the request is specified.
    • Date and signature of the applicant.
    • Documents accrediting the request you make.
    • In the event that the application does not meet the specified requirements, they will be requested to be corrected.
  • The application must be accompanied by the following documentation:
    • If you have not given consent to verify the identity, photocopy of the ID, Passport or Foreigner’s Card. For foreigners who do not have an NIE, they must provide a certified copy of the Passport in force.
    • Judicial certifications or certified copies thereof, which demonstrate the firmness of the resolutions and completion of the procedures with respect to the antecedent or antecedents that are desired to be eliminated.
    • Administrative certifications or certified copies thereof, which prove the effective payment of the fine or be exempt from liability for the facts that motivated the background.
    • Authorization to obtain the Certificate of Criminal Record in the Central Registry of Convicts and Rebels.
