Right of Access to the file "PERPOL"

Article 18.4 of the Spanish Constitution recognizes the fundamental right to the protection of personal data. The purpose of this procedure is to publicize the mechanism, within the framework of the Ministry of the Interior, for the exercise of the rights that current legislation grants to citizens.

The rights listed below are of a very personal and independent nature, so that the exercise of one is not a requirement for the exercise of the other, being regulated in Organic Law 7/2021, of 26 May, on the protection of personal data processed for the purposes of prevention, detection, investigation and prosecution of criminal offences and execution of criminal sanctions.

The exercise by the affected party of his rights will be free of charge.

  • Formal requirements to exercise the right of access to the file "PERPOL"
    • Being a very personal right, it will be exercised by request addressed to the person responsible for the file for the management of the background of persons of police interest (PERPOL) by a means that guarantees their identification and that accredits the shipment.
    • If you have not consented to the verification of your ID, you must provide a photocopy of your ID, Passport or Foreigner’s Card. Foreigners without a NIE must provide a certified photocopy of the Passport in force.

    • The application together with the documentation that must accompany it must be presented at the level of the National Police in any Police Station, National Police Registers or in the Central Police Archive or in any of the registers referred to in Law 39/2015, of 1 October, on the Common Administrative Procedure of Public Administrations.     • The right of access to the file for the background management of persons of police interest (PERPOL) may be exercised on two occasions every 6 months.
    • Acting through a representative

      The rights may be exercised through:

      • Legal representative, when the affected person is in a situation of incapacity or minority age that makes it impossible for him to exercise these rights personally, in which case the accreditation of such condition will be necessary.
      • Voluntary representative, expressly designated for the exercise of the right. In this case, the identity of the representative and the representation conferred by him must be clearly established.
    • Resolution of the request for access to the file "PERPOL":
      • The request for access to the file for the background management of persons of police interest (PERPOL) will be resolved within a month of receipt of the request.
      • The information may be obtained by simply consulting the data by means of its visualization, or indicating the data that are the object of treatment by writing, copying, telecopy or photocopying or by any other procedure that is appropriate to the configuration or material implementation of the file.
    • Communication with the applicant:
      • It will be done through the Police Unit closest to the home indicated in the request for notification.

      • Fill in all the mandatory data to identify the interested party perfectly.
      • It is advisable to fill in both the telephone and the email, since it facilitates the administration to contact the interested party in case of doubt about any aspect of the file, as well as receive a notice about the availability of access to the notification, in case of choosing electronic means such as the preferred one in the procedure.
    • Request. Request.
      • It is mandatory to attach everything necessary to correctly identify the interested party.
      • If you act as a representative, you must prove the relationship of representation, as well as the affiliation of the interested party by means of a copy of your personal document (DNI/NIE/Passport).
    • Notifications.
      • Choose the means of notification for the file, or by electronic appearance with electronic certificate.
      • Or notification on paper, for which it will be necessary to duly fill in all the data of the full address.
    • Protection of data.

  • The exercise of the rights must be carried out by means of a communication addressed to the person responsible for the file for the management of the background of persons of police interest (PERPOL), which will contain:
    • Name and surname of the interested party.
    • Request in which the request is made.
    • Date and signature of the applicant.
    • Documents accrediting the request you make.
    • In the event that the request does not meet the specified requirements, the correction of the same will be requested.
