Passport
The ordinary Spanish passport is a public, personal, individual and non-transferable document, issued by the competent bodies of the General Administration of the State, which accredits, outside Spain, the identity and nationality of Spanish citizens unless proven otherwise, and, within the national territory, the same circumstances of those Spanish non-residents.
All Spanish citizens have the right to obtain the ordinary passport provided that they do not meet any of the following circumstances:
- Have been sentenced to penalties or security measures involving the deprivation or limitation of their freedom of residence or movement, as long as they have not been extinguished, unless they obtain authorization from the competent judicial body.
- When the judicial authority has prohibited his expedition or his departure from Spain in respect of the interested party who is accused in criminal proceedings.
- The Ministry of the Interior must therefore limit this right to it in the context of the measures to be taken in the cases covered by Organic Law 4/1981, of 1 June, regulating states of alarm, exception and siege.
The obtaining of a passport by citizens subject to parental authority or guardianship shall be subject to the express consent of the person or body assigned to exercise it or, in the absence thereof, of the competent judicial body.
